Terms of Service
Last updated 28 July 2026
These Terms govern your use of Proqik, a marketplace connecting customers with independent photography, videography, and editing professionals. By creating an account or booking a session, you agree to these Terms.
1. The Proqik Platform
Proqik is a booking and discovery platform. Professionals listed on Proqik are independent contractors, not Proqik employees — Proqik is not a party to the shoot itself and is not responsible for the quality of creative work delivered.
2. Accounts & Eligibility
You must provide a valid phone number and complete OTP verification to create an account. You are responsible for keeping your account credentials and OTP confidential.
You must be at least 18 years old to book on Proqik or to register as a professional.
3. Bookings & Payments
A booking is confirmed once the advance payment shown at checkout is successfully processed. Package pricing, duration, and add-ons are set by the professional and shown before you pay.
Proqik Instant matches you with an available nearby professional for last-minute requests; the same booking and payment terms apply.
4. Cancellations & Refunds
Cancelling more than 24 hours before the scheduled session: 90% refund.
Cancelling within 24 hours of the session: 50% refund.
Cancelling after the session has started: no refund.
Refunds are credited to your Proqik Wallet, not directly to your original payment method.
5. Proqik Wallet & Payouts
Refunds (customers) and completed-booking payouts (professionals) are credited to the in-app Wallet. Withdrawals to a linked UPI ID or bank account are reviewed and processed by our team rather than settled instantly.
6. Delivered Media
Ownership of final delivered photos and videos transfers to the customer on delivery. Professionals may retain a copy for their own portfolio unless the customer requests otherwise in writing to support.
7. Prohibited Use
You may not use Proqik to arrange payment or bookings outside the platform to avoid fees, harass another user, upload unlawful content, or misrepresent your identity or professional credentials.
Leads, enquiries, and introductions generated through Proqik belong to the Proqik marketplace. Services introduced through Proqik must not be moved outside the platform to avoid Proqik’s commission or service fees.
Before a booking is confirmed and paid for, customers and professionals must not exchange personal contact information — phone numbers, WhatsApp/Telegram/Signal handles, email addresses, or social media accounts (Instagram, Facebook, Snapchat, etc.) — for the purpose of bypassing Proqik, whether in chat, a profile, a portfolio image or video, or a payment QR code.
Once a booking is confirmed and the required advance payment has been made, you may exchange contact details as needed to coordinate that booking — for example, sharing a phone number to confirm arrival, a WhatsApp number for last-minute updates, or a map link to the venue. That communication channel must not, however, be used to solicit or arrange a future service outside Proqik in order to avoid platform fees or protections — see Section 8 below.
Payments arising from an introduction made through Proqik, and any future bookings arising from that introduction, must remain within the Proqik platform unless an official Proqik feature explicitly allows otherwise.
You may not encourage or request the cancellation of a confirmed Proqik booking in order to complete the transaction privately.
8. Marketplace Integrity & Trust and Safety
Proqik operates automated Trust & Safety systems that screen booking chat messages and portfolio media for prohibited contact-sharing (before a booking is confirmed and paid for), fraud indicators, and attempts to solicit or arrange future business outside Proqik — see the Prohibited Use clause above. These systems check platform activity against these Terms; they do not make judgments about the creative quality of anyone’s work, and they do not treat ordinary coordination of an already-booked, already-paid event as a violation.
A flagged chat message may be blocked from sending or held for review, and a flagged portfolio upload may be held from public view, before either reaches its intended audience.
Violations are handled progressively: a first violation typically results in a warning, a further violation may restrict your chat or booking access, and repeated or severe violations may lead to automatic account suspension. Certain serious violations (for example, sharing a payment link to move a transaction off-platform, or soliciting a future booking outside Proqik to avoid platform fees) may result in immediate suspension or account review without a prior warning.
If you believe an automated decision was made in error, you may appeal it — see "Appeals" in the Termination section below.
9. Limitation of Liability
Proqik is provided "as is". To the extent permitted by law, Proqik is not liable for indirect or consequential damages arising from a booking, including dissatisfaction with creative work delivered by a professional.
10. Termination
We may suspend or terminate an account that violates these Terms, including fraudulent bookings, repeated cancellations, attempts to circumvent the marketplace (see Section 8), or abusive behaviour toward other users.
Appeals: if your account or chat/booking access has been restricted or suspended and you believe this was a mistake, you can appeal through Contact Us or Chat with Support (Profile → Help & FAQ). Include your account details and why you believe the action was incorrect — our Trust & Safety team reviews appeals and will respond with the outcome.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of Proqik after an update constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of India.
